The property was on the market two years ago for $16.9 million , with the current home set to be knocked down.
The local government knocked back plans in 2025, calling it an “overdevelopment” with “extensive evacuation”.
The council also said the “removal of native vegetation” could impact views from Main Beach.
That has been denied by lawyers for the current CEO of retail drinks and hospitality business Endeavour Group, who will argue it meets planning codes.
Experts speaking in favour of it say it “will make a positive contribution to the local architectural character and identity”.
A judge previously accused the local government of getting in the way of development.
A potential six-day court battle started on Monday with a site visit to the exclusive real estate pocket.
