Telangana High Court lifts stay on one of eight G.O.s related to Kalyana Lakshmi, Shadi Mubarak

The Telangana High Court on Monday removed the stay order on Government Order (G.O.) Ms. No. 4 providing financial assistance of ₹1.25 lakh to physically challenged unmarried women under the Kalyana Lakshmi and Shaadi Mubarak schemes.

However, the stay order against the seven other G.O.s through which financial assistance was being provided to unmarried women under the two schemes would continue for another two weeks.

Justice N.V. Shravan Kumar, who earlier passed the interim stay order against the eight G.O.s, declined to vacate the stay order against all eight G.O.s.. An advocate, Vijay Gopal of the HC, filed a writ petition challenging the constitutional validity of the implementation of the two welfare schemes. He contended that the government had to strike a fiscal balance. The eight G.O.s facilitating financial assistance to unmarried women of different sections had no legal sanctity was his contention.

The judge allowed petitions filed by the All India Majlis-e-Ittehadul Muslimeen MLAs Majid Hussain and Ahmed Bin Abdullah Balala seeking to implead them in the writ petition filed by Vijay Gopal. During submission of arguments, the judge sought to know from Additional Advocate General Mohammed Imran Khan as to how MLAs were distributing cheques issued under the two welfare schemes. He observed that the implementation of the two schemes assumed political tinge with the legislators being involved in distribution of cheques to beneficiaries under the schemes.

Justice Shravan Kumar said the government should assign the responsibility of distribution of cheques to the authorities and not to the legislators. The counsels for the MLAs sought dismissal of the writ petition, contending that it was filed with a vested interest. Some forces attempting to thwart the financial assistance to unmarried women from underprivileged and from lower strata of the society were behind the plea, they said.
