ConCourt to deliver judgment in ANC candidate case on Thursday
The Constitutional Court is expected to deliver judgment on Thursday in the ANC’s bid to have 181 councillor candidates reinstated on the ballot ahead for the 4th November Local Government Elections (LGE).
The ANC approached the Apex court on Monday to challenge the Electoral Commission’s (IEC) decision to disqualify its candidate lists in six municipalities.
The dispute centres on the ANC’s alleged failure to click the “Submit as Final” button on the IEC’s online nomination system.
The party argued that it had complied with the nomination requirements, while the IEC maintained that the lists were not validly submitted.
Meanwhile, IEC CEO Sy Mamabolo says they will abide by whatever decision the judicial systems decide on.
A number of parties have gone to the Electoral Court and the Constitutional Court over the IEC’s decision not to include some candidates on the PR list.
Mamabolo was briefing the media on the state of readiness for the upcoming November 4th LGE.
“The ConCourt is the arbiter of disputes of final instance.
So, whatever decision that may come out of there will have to be integrated into the operations of the Commission.
At this stage the Commission is not contemplating any change in dates.
We are working on the 4th.
It is important that all the judicial bodies are given the space to consider the merits of the matters and come to a judicious decision in respect of all matters before either the electoral court or the constitutional court.”
