Former top cop Shadrack Sibiya denied bail in alleged rape case

The Randburg Magistrate’s Court has denied former Deputy National Police Commissioner for Crime Detection, Shadrack Sibiya, bail.

Sibiya was arrested last month at a Strip Club in Sandton and faces charges, including the alleged sexual grooming of a 16-year-old girl, rape, human trafficking and the contravention of the Firearms Control Act.

Last week, the state argued that it would be an injustice to grant Sibiya bail, considering the charges he faces.

During the bail application, the court heard graphic details on day two of Sibiya’s bail application, as the investigating officer read out the WhatsApp conversations between Sibiya and the 16-year-old girl, whom he allegedly sexually groomed.

According to investigating officer Detective Sergeant Nokukhanya Ndlovu, the WhatsApp messages from Sibiya to the young girl were of an extremely explicit nature.

She further testified that Sibiya made several calls to the victim asking her to send him x-rated pictures and videos of herself.

The court also heard evidence from Sibiya’s son, Ofentse Magwenya, via an affidavit – read out by his attorney Estelle Kilian, stating that bishop Azwihangwi Maumela acted of his own accord when he contacted one of the complainants in the case.

Live stream: Sibiya could ‘harm complainants’ The investigating officer told the court that there is a high likelihood that Sibiya may harm the complainants in the case.

Ndlovu added that there is strong evidence which indicates that Sibiya will attempt to interfere with the state’s case.

“The accused’s actions are beyond reasonable doubt that he is likely to harm Mr M or ZM, who are well known to him and whose contact details are known to him.

This is evidence as per his phone call at the time I was opening the current case.

This may not be regarded as mere coincidence.

A reasonable inference may be drawn that he was personally stalking Mr M or he had someone who did so on his behalf.” VIDEO | State opposes bail for Sibiya citing witness intimidation Sibiya resigned Two weeks ago, the South African Police Service (SAPS) said it regarded Sibiya’s resignation as a ‘dishonourable discharge’ because disciplinary hearings were already under way.

Sibiya’s legal representative tendered his resignation after the commencement of his disciplinary proceedings.
