Brown Mogotsi’s 12 police dockets: NPA closes the door on reopening cases
The North West NPA has reviewed 12 dockets involving Brown Mogotsi, including matters linked to allegations of murder, kidnapping, assault and fraud, and found that they were handled lawfully and should not be reopened.
The National Prosecuting Authority (NPA) in North West has confirmed to IOL that it received 12 dockets it had requested from the police earlier this year involving controversial businessman Brown Mogotsi and that it found no grounds to reopen the matters, as they had been handled in accordance with the law.
The NPA requested that the South African Police Service (SAPS) submit all dockets involving Mogotsi to establish whether decisions taken in the respective matters were lawful.
Earlier this year, IOL reported that police in the North West had sent more than 10 dockets linked to Mogotsi to the NPA.
North West provincial police spokesperson Colonel Adéle Myburgh confirmed at the time that SAPS had received the NPA's request.
"A request was received from the NPA for all dockets relating to Brown Mogotsi. There are quite a number of them (more than 10)," she said.
The cases included allegations of kidnapping, murder, assault, reckless and negligent driving, assault with intent to cause grievous bodily harm (GBH), and defeating the ends of justice.
Myburgh said the dockets were being provided to the NPA for further scrutiny.
In response to IOL's follow-up inquiries, NPA North West communications officer Lindiwe Mabasa confirmed that 12 dockets had been received from SAPS and reviewed.
"It can further be confirmed that 12 dockets were received from SAPS and checked by the NPA," Mabasa said.
"It was established that the matters had been dealt with in accordance with the law."
Mabasa said the NPA was satisfied that the decisions taken in all 12 matters were correct.
"The NPA is satisfied that the decisions taken in respect of all the dockets were correct," she said.
Mabasa said prosecutorial decisions are based on the available evidence and the applicable legal framework.
