ANC tells ConCourt it complied with all IEC’s statutory requirements
The African National Congress (ANC)’s legal representative, Advocate Daniel Burger, has argued at the Constitutional Court that the party complied with all statutory and regulatory requirements for candidate nominations before the Independent Electoral Commission (IEC) deadline.
The Constitutional Court is considering the ANC’s challenge to a decision to disqualify its candidate lists in six municipalities ahead of the 4 November 2026 local government elections.
Burger has argued that all candidate details, supporting documents and required deposits had been uploaded to the IEC’s online system before the deadline.
He submitted that the only omission was the failure to click the “submit as final” button, which he argued is not a requirement under the Electoral Act or its regulations.
Burger says the ANC’s exclusion from the ballots in six municipalities therefore raises a question of legal interpretation rather than non-compliance.
“The ANC completed all the electronic forms on the system and uploaded all the annexures onto the system before the 5 p.m. deadline, and therefore the ANC complied.” Live stream:
